Terms of Use
1. Acceptance of these Terms
These Terms of Use ("Terms") form a legally binding agreement between you and Prince Tires ("we," "us," "our") covering your use of our website at princetires.ca (the "Site"), our online store, our service-booking system, our wholesale portal, our mobile and desktop forms, and any related products or services we provide (collectively, the "Services").
By using the Site or Services, by creating an account, by placing an order, by booking an appointment, or by accepting these Terms in any other way, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Site or Services.
We may update these Terms from time to time. The "Effective" date at the top indicates the current version. Continued use of the Site or Services after a change means you accept the updated Terms.
2. Who may use the site & services
You may use the Site and place orders if you are at least 18 years old, have the legal capacity to enter into a contract, and are using the Services for personal or business purposes that comply with these Terms and applicable law. We do not knowingly do business with anyone under 18.
We may refuse, suspend, or terminate access to the Site or Services to any person at any time, in our reasonable discretion, including where we suspect fraud, abuse, breach of these Terms, or any unlawful conduct.
3. Customer accounts
You may browse most of the Site without an account, but some features (such as saving vehicles, wholesale pricing, and order history) require one. When creating an account you agree to:
- Provide accurate, current, and complete information
- Keep your password confidential
- Take responsibility for all activity that occurs under your account
- Notify us promptly at info@princetires.ca if you suspect unauthorized use
We are not liable for any loss caused by unauthorized use of your account that you could have prevented by following the practices above.
4. Orders, pricing & availability
All prices on the Site are shown in Canadian dollars (CAD) and exclude applicable taxes and shipping unless we say otherwise. We try to keep pricing and inventory up to date, but errors and stock changes do happen.
- Order acceptance. Your order is an offer to buy at the displayed price. We accept your offer when we send a confirmation that your order has shipped or been picked up. Until then, we may decline or cancel any order at our sole discretion.
- Pricing errors. If a product is listed at an obviously incorrect price (for example, due to a typographical or technical error), we may cancel the order and issue a full refund, even after a payment confirmation has been sent.
- Inventory. Listed items are subject to availability. If a product becomes unavailable after you have paid, we will notify you and offer a comparable substitute or a full refund.
- Quantity limits. We reserve the right to limit the quantity of any product purchased per customer or per order, and to refuse orders we reasonably believe are placed by resellers without authorization.
5. Payment, taxes & currency
We accept the payment methods displayed at checkout, which may include Visa, Mastercard, American Express, Interac Online, Apple Pay, Google Pay, and (for approved trade accounts) net-terms invoicing. By submitting payment, you represent that you are authorized to use the payment method.
We do not store full credit-card numbers. Card data is processed by our PCI-compliant payment processors. Failed or declined transactions may delay or cancel your order.
All applicable Canadian federal and provincial taxes (including 5% GST) are calculated at checkout based on your billing or shipping address. For purchases shipped or fulfilled outside Alberta, the applicable provincial taxes apply.
6. Shipping & delivery
Shipping options, lead times, and rates are displayed at checkout and depend on the items, your address, and the courier. We typically ship within 1–3 business days of order confirmation; transit time varies by destination.
- Title and risk. Title and risk of loss to ordered products pass to you when the products are delivered to the courier (FOB origin), unless we agree otherwise in writing.
- Failed deliveries. If the courier is unable to deliver because of an incorrect address, refusal of delivery, or inability to reach you, we may charge a return-shipping or restocking fee.
- Customs & duties. For shipments outside Canada, you are responsible for any import duties or taxes.
- Local pickup. Where local pickup is offered, you must pick up your order within 30 days of the pickup-ready notification. After 30 days unclaimed orders may be re-stocked and refunded less a 15% restocking fee.
7. Service appointments & bookings
You may book tire installation, balancing, rotation, flat repair, TPMS service, and seasonal swap appointments through our online booking system or by phone or text.
- Lead time. Online bookings require a minimum lead time (typically 6 hours). Earlier service may be available by calling us; subject to availability.
- Confirmation. Your booking is confirmed only when you receive an email or SMS confirmation from us.
- Reschedules & cancellations. You may reschedule or cancel free of charge using the link in your confirmation email up to 4 hours before your appointment. Within 4 hours of the appointment, no-shows or last-minute cancellations may be subject to a $50 inconvenience fee.
- Late arrivals. If you arrive more than 15 minutes late, we may need to reschedule your appointment to keep on time for other customers.
- Estimated times. Quoted service times are estimates; complications discovered during work may extend them. We will tell you if a job will run materially longer than estimated.
8. Installation & workmanship
We warrant our workmanship on tires we install for 90 days from the date of service against defects in mounting, balancing, and torque. If a workmanship issue arises within 90 days, we will re-perform the service at no charge.
Our workmanship warranty does not cover:
- Damage caused by impacts (potholes, curbs, debris) after the install
- Damage caused by neglect, modification, racing, or off-road use
- Pre-existing wheel, rim, suspension, or alignment issues we identified and disclosed at intake
- Tires installed on wheels we did not supply if the wheel turns out to be defective or not appropriate for the tire
For all installs you give us informed consent to mount, balance, and torque the tires you have purchased, and to perform any related safety inspection, and you confirm that the wheels and vehicle are appropriate for the tires you have selected.
9. Tire warranty & manufacturer claims
New tires are covered by the manufacturer's tread-life and limited warranty, which we will pass through to you. Manufacturer warranty terms vary by brand and model and are documented on the manufacturer's website or warranty card.
If a manufacturer-warranty issue arises, we will:
- Inspect the tire and document the wear or defect
- Submit a claim to the manufacturer on your behalf where allowed
- Apply any manufacturer credit toward a replacement, with you paying the prorated balance, mounting, balancing, valve stems, taxes, and disposal where the manufacturer does not cover them
Manufacturer warranties do not generally cover road-hazard damage, improper inflation, neglect, racing, or off-road use. A separate road-hazard protection plan may be available at the time of purchase. Coverage details and limits will be provided in writing when you purchase the plan.
10. Vehicle drop-off, storage & release
When you leave a vehicle with us for service:
- You authorize our technicians to test-drive the vehicle a short distance for diagnostic and balance verification.
- You confirm that you are the legal owner of the vehicle (or are duly authorized to authorize service on it).
- You agree that we are not responsible for items left in the vehicle, including aftermarket electronics, valuables, and personal effects.
- You agree to pick up your vehicle within 5 business days of the service-complete notification. After 5 business days a daily storage fee of up to $25 per day may apply.
- If a vehicle is left more than 90 days after the service-complete notification despite our reasonable efforts to contact you, we may treat it as abandoned and dispose of it under the Garage Keepers' Lien Act (Alberta) and recoup unpaid charges from the proceeds.
Old tires removed from your vehicle are disposed of under our environmental tire-disposal contract. You consent to that disposal unless you tell us at intake that you wish to keep the old tires.
11. Wholesale & trade accounts
Wholesale pricing is available only to approved trade accounts (auto repair shops, dealerships, fleet operators, and similar businesses). Trade accounts are subject to:
- Approval based on a completed application, business documentation, and (where applicable) a credit check
- Resale-only restrictions (wholesale stock may not be re-listed on consumer marketplaces without our written approval)
- Net payment terms agreed in writing; overdue balances may be charged interest at 2% per month (24% per year) and may result in account suspension
- Minimum order quantities, freight terms, and return policies as set out in your trade-account agreement
Wholesale orders are governed by these Terms together with any signed trade-account agreement; in the case of conflict, the trade-account agreement controls.
12. Intellectual property
All content on the Site — including text, graphics, logos, photographs, illustrations, software, layouts, the "Prince Tires" word mark, and any trade marks displayed — is owned by or licensed to us and is protected by Canadian and international intellectual-property law.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes (or, for trade-account holders, internal business purposes). You may not copy, reproduce, republish, scrape, frame, mirror, sell, sublicense, or create derivative works from any part of the Site without our prior written consent, except as expressly permitted by these Terms or by law.
Tire and parts manufacturer trade marks shown on the Site are the property of their respective owners and are used to describe the products we sell.
13. User content & reviews
If you submit reviews, photos, comments, suggestions, or other content to us or to our public profiles ("User Content"), you grant us a worldwide, royalty-free, perpetual, non-exclusive licence to use, reproduce, modify, publish, and display that content in connection with our business and to promote our products and services.
You confirm that any User Content you submit:
- Is your original work or you have the right to share it
- Is honest and accurate
- Does not infringe anyone's intellectual-property, privacy, or other rights
- Is not threatening, harassing, defamatory, obscene, or unlawful
We may remove or refuse to publish User Content at any time without notice or explanation.
14. Acceptable use
When using the Site or Services, you agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Interfere with or disrupt the Site, servers, or networks (for example, by sending excessive requests, scraping at scale, or attempting to bypass authentication)
- Use bots, scrapers, or automated tools to copy or extract content without our written consent
- Reverse-engineer or attempt to derive source code from any part of our Services
- Impersonate another person or misrepresent your affiliation with anyone
- Submit fraudulent orders, payments, or wholesale applications
- Send unsolicited commercial messages through any of our forms or contact channels
Violations may result in account suspension or termination, cancelled orders, blocked access to the Site, and (where applicable) civil or criminal liability.
15. Disclaimers, liability & governing law
15.1 Disclaimers
The Site and Services are provided "as is" and "as available." Except for express warranties stated in writing — and except for the implied conditions of fitness for purpose, acceptable quality, and matching description that apply under the Alberta Sale of Goods Act and the Consumer Protection Act for consumer transactions and that cannot lawfully be excluded — we disclaim, to the fullest extent permitted by law, all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses.
15.2 Limitation of liability
To the fullest extent permitted by law, our total aggregate liability to you for any claim arising out of or relating to the Site, the Services, or any product purchased from us is limited to the greater of (a) the amount you paid us for the specific product or service giving rise to the claim, or (b) one hundred Canadian dollars ($100 CAD).
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, lost goodwill, or business interruption, even if we have been advised of the possibility of those damages.
Nothing in these Terms limits our liability for fraud, fraudulent misrepresentation, death or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded or limited under Alberta law.
15.3 Indemnity
You agree to indemnify and hold harmless Prince Tires and its directors, employees, and contractors from and against any claims, damages, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of any law, or your infringement of any third-party right.
15.4 Governing law & jurisdiction
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply in Alberta, without regard to conflict-of-laws principles. The courts of Alberta have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, except that we may seek injunctive or equitable relief in any competent court.
15.5 Severability & entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms (together with our Privacy Policy and any applicable trade-account agreement) form the entire agreement between you and us regarding the Site and Services and supersede any prior or contemporaneous understandings.
